Research studies increasingly use genomic sequencing to draw inferences based on comparisons between the genetic data of a set of purportedly related individuals. As use of this method progresses, it will become much more common to discover that the assumed biological relationships between the individuals are mistaken. Consequently, researchers will have to grapple with decisions about whether to return incidental findings of misattributed parentage on a much larger scale than ever before. Recent scholarship in intellectual humility (IH) has attempted to provide deeper understanding of the virtue as personality trait and its impact on an individual's thoughts, beliefs, and actions. A limitations-owning perspective of IH focuses on a proper recognition of the impact of intellectual limitations and a motivation to overcome them, placing it as the mean between intellectual arrogance and intellectual servility. We developed the Limitations-Owning Intellectual Humility Scale to assess this conception of IH with related personality constructs. In Studies 1 (...) (n= 386) and 2 (n = 296), principal factor and confirmatory factor analyses revealed a three-factor model – owning one's intellectual limitations, appropriate discomfort with intellectual limitations, and love of learning. Study 3 (n = 322) demonstrated strong test-retest reliability of the measure over 5 months, while Study 4 (n = 612) revealed limitations-owning IH correlated negatively with dogmatism, closed-mindedness, and hubristic pride and positively with openness, assertiveness, authentic pride. It also predicted openness and closed-mindedness over and above education, social desirability, and other measures of IH. The limitations-owning understanding of IH and scale allow for a more nuanced, spectrum interpretation and measurement of the virtue, which directs future study inside and outside of psychology. Background: Clinical genomic implementation studies pose challenges for informed consent. Consent forms often include complex language and concepts, which can be a barrier to diverse enrollment, and these studies often blur traditional research-clinical boundaries. There is a move toward self-directed, web-based research enrollment, but more evidence is needed about how these enrollment approaches work in practice. In this study, we developed and evaluated a literacy-focused, web-based consent approach to support enrollment of diverse participants in an ongoing clinical genomic implementation study. (...) Methods: As part of the Cancer Health Assessments Reaching Many (CHARM) study, we developed a web-based consent approach that featured plain language, multimedia, and separate descriptions of clinical care and research activities. CHARM offered clinical exome sequencing to individuals at high risk of hereditary cancer. We interviewed CHARM participants about their reactions to the consent approach. We audio recorded, transcribed, and coded interviews using a deductively and inductively derived codebook. We reviewed coded excerpts as a team to identify overarching themes. Results: We conducted 32 interviews, including 12 (38%) in Spanish. Most (69%) enrolled without assistance from study staff, usually on a mobile phone. Those who completed enrollment in one day spent an average of 12 minutes on the consent portion. Interviewees found the information simple to read but comprehensive, were neutral to positive about the multimedia support, and identified increased access to testing in the study as the key difference from clinical care. Conclusions: This study showed that interviewees found our literacy-focused, web-based consent approach acceptable; did not distinguish the consent materials from other online study processes; and valued getting access to testing in the study. Overall, conducting empirical bioethics research in an ongoing clinical trial was useful to demonstrate the acceptability of our novel consent approach but posed practical challenges. (shrink)

Hundreds of millions of rare biospecimens are stored in laboratories and biobanks around the world. Often, the researchers who possess these specimens do not plan to use them, while other researchers limit the scope of their work because they cannot acquire biospecimens that meet their needs. This situation raises an important and underexplored question: how should scientists allocate biospecimens that they do not intend to use? We argue that allocators should aim to maximise the social value of the research enterprise (...) when allocating scarce biospecimens. We provide an ethical framework for assessing the social value of proposed research projects and describe how the framework could be implemented. (shrink)

Identifying the necessary and sufficient conditions for individuating and classifying diseases is a matter of great importance in the fields of law, ethics, epidemiology, and of course, medicine. In this paper, I first propose a means of achieving this goal, ensuring that no two distinct disease-types could correctly be ascribed to the same disease-token. I then posit a metaphysical ontology of diseases—that is, I give an account of what a disease is. This is essential to providing the most effective means (...) of interfering with disease processes. Following existing work in the philosophy of medicine and epidemiology (primarily Christopher Boorse; Caroline Whitbeck; Alexander Broadbent), philosophy of biology (Joseph LaPorte; D.L. Hull), conditional analyses of causation (J.L. Mackie; David Lewis), and recent literature on dispositional essentialism (Stephen Mumford and Rani Anjum; Alexander Bird), I endorse a dispositional conception of disease. Following discussion of various conceptions of disease-identity, their relations to the clinical and pathological effects of the diseases in question, and how diseases are treated, I conclude (i) that diseases should be individuated by their causes, and (ii) that diseases are causal processes best seen as simultaneously acting sequences of mutually manifesting dispositions. This article seeks to understand the origins of the Soviet concept of ‘sluggish schizophrenia’, a diagnostic category that was used to imprison political dissidents in the post-WWII era. It focuses on the 1920s and 1930s, a period when Soviet psychiatrists attempted to find ways to diagnose schizophrenia at its earliest stages. The new Soviet state supported these efforts, funding new institutions where clinicians encountered types of patients they had not previously studied. Conceptual disagreements arose about what symptoms could be used (...) to diagnose schizophrenia, and how it could be differentiated from other ‘borderline’ mental disorders such as neurosis and psychopathy. Several research groups used their findings to propose new clinical concepts, including ‘mild schizophrenia’ and sluggish schizophrenia. By the early 1930s Soviet psychiatrists no longer shared a basic consensus about schizophrenia. At the same time, the priorities of the Soviet government under Joseph Stalin ceased to support preventative psychiatry. The result was a 1936 ‘discussion’ at which the concept of mild schizophrenia was criticized and sluggish schizophrenia was held up as a model for how the discipline should develop in the future. In believing or acting on authority, an agent appears to believe or act without making up her own mind about what is the case or what to do. How is this possible? How can an agent make up her mind about a theoretical or practical question, and so believe or act intentionally, without doing so for herself? This paper argues that the standard account available in the literature of how it is that an agent can make up her mind without (...) doing so for herself, an account framed in terms of Joseph Raz’s notion of preemptive reasons, fails to adequately distinguish our rational dependence on other agents from reliance on ordinary instruments. It then offers an alternative account of what it is to make up one’s mind without doing so for oneself, one that focuses on the way in which the kind of rational responsibility that accrues to instances of settling a theoretical or practical question can be interpersonally distributed between agents and authorities. Investigating the nature of our apparent physical reality is a profound challenge. Our models from physics, while powerful, do not treat reality per se. The famous painter Paul Gaugin articulated the relevant existential questions famously in a grand painting - questions that also give the painting its title: D’où venons-nous? Que sommes-nous? Où allons-nous? People of religious faith, of course, assume that one can know the ultimate truth of reality, and, then, know the answers to these questions. But even in (...) such a case, there is the issue of how a believer has obtained their faith, through a revelatory or other epistemological process. Joseph Campbell grasped the difficulty of framing the key questions, noting that, “the transcendent is unknowable and unknown. God is transcendent, finally, of anything like the name ‘God.’ God is beyond names and forms.” This metaphysical puzzle concern, in part, models. Physics uses models, and such models are powerful tools: they allow us to navigate through the physical reality we live in, and manipulate aspects of it. However, the models do not lead humanity closer to any ultimate truth, or even give us a clue that there might be an ultimate truth. The problem of using models and talking about reality can be viewed in a new way however, using certain structures in Chinese philosophy. The ancient Dao De Jing states: “The heavens and the earth are not partial to institutionalized morality”. We can extend that to say, “The universe is not partial to institutionalized models”. Combining the philosophy and musicology of T.W. Adorno, Walter Benjamin, and Gilles Deleuze, Joseph Weiss makes an original contribution to the field of aesthetics and critical theory. This article develops a sociological reading of Walter Benjamin’s ‘Arcades Project’, or Passagen-werk . Specifically, the essay seeks to make explicit Benjamin’s non-dualistic account of structure and agency in the urban milieu. I characterize this account as the ‘dialectic of urbanism’, and argue that one of the central insights of Benjamin’s Passagen-werk is that it locates an emergent and innovative cultural form - a distinctive ‘street culture’ or jointly shared way of modern urban life - within haussmannizing (...) techniques of architectural administration and spatial domination. In the modern metropolis, Benjamin sees a new kind of collective - an embedded and effervescent sociocultural group held together not by the functionalist imperatives of capitalist urban planning but by an improvisational mode of street life. A common difficulty with the application of theories of justice to the allocation of medical resources is the assumption that one perspective is primary, whether that privileged perspective be that of the practitioner, on the one hand, or policy analyst on the other. By a discussion of three theories — those of Ramsey, Childress, and Joseph Fletcher — I attempt to show that these perspectives must be treated as related. As a result, values and ethics expressed in micro-allocation should (...) be uniform with those of macro-allocation. This point has implications for such issues as substance and procedure in just decision, the role of the political process in medical allocation, and the definition of health and health services. In his recent commentary on my work, entitled ‘Mazor on indirect obligations to conserve natural resources for future generations’ (Sachs, 2013), Benjamin Sachs explores whether the argument I have provided for grounding indirect obligations of justice to conserve natural resources for future people really succeeds. Sachs insightfully points out that it does not necessarily follow from the fact that profligate individuals increase the obligation of others to conserve natural resources, that those others can insist that the profligate individuals do (...) their fair share. Sachs argues that this only follows if those who are obligated to pick up the slack have been wronged (Sachs, 2013, pp. 209). Furthermore, he argues that in order to be wronged, they must have been harmed (Sachs, 2013, p. 210). And since the obligation to conserve natural resources is, according to Sachs, not taken seriously, those who do not pick up the slack for others’ overuse are not being harmed. Therefore, Sachs concludes, my argument for indirect obligations to conserve natural resources for future people is on shaky ground. (shrink)

Entering the park like a second Theseus following his Ariadne along the thread of erotic sensations, he discovered therein (...) the myth-realm of the ancient gods as transfigured in the bourgeois decorations of the Second Reich, most visibly so in the aristocratic monuments of Friedrich Wilhelm and Queen Louise: “They towered up from their round pedestals among the flower beds as if spellbound by magic curves that a watercourse had inscribed before them in the sand.” 1 As he invoked these primal visions thirty years later, Benjamin realized that they prefigured “the features of what is to come,” that is, he recognized in his early experiential impressions the topical concerns that were to determine his life and works. He then understood that he had been finding signs of “the return of the ancient gods” everywhere:Under their sign the Old West of Berlin was transformed into the West of antiquity, whence the western winds come to the mariners, who navigate their boat with the Hesperidan apples slowly upward the Landwehrkanal, in order to cast anchor near the Herkules Bridge. This article explores the work of the contemporary sociologist and urban photographer, Camilo Vergara. The piece draws on early work in critical theory to characterize Vergara's work as `rescuing critique'. Specifically, the article maintains that it is only in the theoretical vocabulary of Walter Benjamin that the methodological uniqueness, historical sensitivity and critical thrust of Vergara's project can be adequately understood. Indeed, it is argued that what is truly distinct about Vergara's work is the decidedly Benjaminian way in which, (...) in the ruinous present of neoliberal `progress', it fuses the aesthetic power of images with an anamnestic obligation to the urban past. In such a fusion, Vergara's photo-ethnographies of America's new ghettos raise critical questions about what has – and might yet – become of such places, and those who inhabit them. (shrink)

In a small portion of The Origin of German Tragic Drama, Walter Benjamin engages in a critique of Nietzsche’s understanding of tragedy in The Birth of Tragedy. He argues that Nietzsche’s account divests individuals of significance in the tragic worldview. The corrective to Nietzsche’s view, according to Benjamin, is a reflective, historical approach to the Greek social and literary phenomenon of tragic poetry. I argue that Benjamin’s approach to tragedy and to The Birth of Tragedy is inherently (...) flawed. The paper has threesections: (1) a presentation of Benjamin’s critique of Nietzsche in The Origin of German Tragic Drama; (2) a refutation of that critique on the basis of a reading of The Birth of Tragedy; and (3) a rejection of Benjamin’s theory of tragedy on the basis of Nietzsche’sinsights into the relation to human significance of both tragedy and the science of history. The first collection of its kind, The Continental Philosophy of Film Reader is the essential anthology of writings by continental philosophers on cinema, representing the last century of film-making and thinking about film, as well as all of the major schools of Continental thought: phenomenology and existentialism, Marxism and critical theory, semiotics and hermeneutics, psychoanalysis, and postmodernism. Edited by Thomas A. Tweed and Stephen Prothero. New York: Oxford University Press, 1999. 416 pp. Although this book is not about interreligious dialogue per se, it makes several important contributions to it. Two of the necessities for successful interreligious dialogue are a knowledge (...) of the religions of other cultures and an awareness of one's own culture's past misinterpretations of these religions in order to guard against repeating them. This book helps accomplish both of these aims very well. First it helps to understand Asian religions as they are practiced in the United States. This book discusses Hinduism, Buddhism, Shinto, and Chinese religions in America, and it includes selections on Jainism and Sikhism; (it excludes Islam as a monotheistic religion with Middle Eastern roots). Second, the book adroitly catalogues the ways that Americans have misinterpreted Asian religions in the past. Its selections demonstrate that two of the worst errors that Americans commit in dealing with Asian religions is either romanticizing them as being all "spiritual," and thus categorically different from the "worldly" West, or of ignoring their diversity. Anyone reading these selections will be less likely to repeat these errors.The book is an anthology of primary documents with well-written, brief introductions to the selections. Its aim is not just to describe Asian religions in America, but also to document American encounters with Asian religions since the American Revolution. The book is organized historically in four major sections: 1784-1840, 1840-1924, 1924-1964, and 1965 to the present. Within each historical section, the authors have chosen selections that illustrate how Americans during that time viewed Asian religions, how Asian religions were practiced in the U.S., and how Asian religions influenced American culture during that time period.The first section (1784-1840) is, not surprisingly, the shortest. It has one chapter on how Americans abroad viewed Asian religions and another chapter on how those at home viewed Asian religions. This period is dominated by a belief that Christianity is the one, true religion; Asian religions by contrast, are full of "debasing superstitions and cruel abominations" (p. 58). Even those who try to get beyond such crude views demonstrate a gross ignorance of Asian religions. For example, Hannah Adams (the first woman in America to support herself through writing) claimed that the Dalai Lama was the spiritual leader or "pope" of China as well as Tibet (p. 55). Better informed and more balanced are the comments from two of the period's most important intellectuals, Benjamin Franklin and John Adams. Franklin, like other Deists, admired Confucian naturalism and humanism, and he reprinted excerpts of Confucius in the Pennsylvania Gazette. John Adams defended the sublimeness of Indian religion, claiming that it had heavily influenced Greek philosophy because Pythagoras had learnt his most important doctrines there.The second section (1840-1924) has six chapters covering missionaries and their [End Page 299] critics, literary encounters with Asian religions, the World Parliament of Religions, the immigrant experience in America, academic discussions, and American sympathizers and converts to Asian religions. Several selections from nineteenth-century dictionaries and books show how Asian religions were commonly perceived at the time. While there was growing sophistication about Asian religions, the period's most popular book on the subject (James Freeman Clarke, Ten Great Religions) still maintained that only Christianity had the fullness of truth and Asian religions were static and stunted. On the other hand, this section balances out Christian triumphalism with some excerpts from Henry Steel Olcott and other Americans who converted to Asian religions. Substantial selections from Emerson, Whitman, Thoreau, and T. S. _What, After All, Is a Work of Art? _directs our attention toward historicity, the inherent historied nature of thinking, and the artifactual, culturally emergent nature of both art and human selves. While these are familiar themes in Margolis's well-known studies of art and culture, they are largely neglected in English-language aesthetics and even philosophy in general. Margolis brings these primary themes to bear on a number of strategically selected issues: the modernism/postmodernism dispute; the treatment of modernist and "post-historical" painting in (...) Clement Greenberg and Arthur Danto; the coherence of relativism in interpreting art and the relevance of cultural relativity; the difference between artworks and persons as culturally constituted entities in contrast to natural entities and with regard to the logic of interpretation; the import of film on the theory of the relationship between understanding ourselves and understanding art, with special attention to the views of Walter Benjamin; and the propriety of the analogy between artworks and selves, as cultural entities, by way of treating the arts as a form of human "utterance." Although the argument is largely focused on certain particularly strenuous puzzles in the philosophy of art, the validity of Margolis's claims are more far reaching. If, through incorporating the reality of physical and biological nature, the emergence of art and human selves cannot rest satisfactorily on exemplars selected from nature alone, then certain fashionable views of science, of canons of understanding, conceptual resources, logic, rationality, and the like may well have to yield ground to ampler models that have been largely marginalized or overridden. In particular, the admission of historicity, the nerve of Margolis's argument, invites a decisive conceptual reorientation. _What, After All, Is a Work of Art? _is based on a series of lectures Margolis delivered at various universities in Japan in the Spring of 1997, while serving as a fellow of the Japan Society for the Promotion of Science. Against the backdrop of Walter Benjamin's famous essay, “Unpacking My Library”, this article, by the Librarian of the Warburg Institute, tells the story of the many times that the Warburg Library has been packed and unpacked. First it was the private collection of Aby Warburg, later a public institution, originally in Hamburg and then in London from 1933 to the present. This essay also explores the various ways in which books have been — and continue to be — acquired (...) by the Warburg Library, including publication, donation, recommendation, and purchase. Each of these methods is not only discussed but also examined in light of Benjamin's account of the acquisition of his own library. Moreover, Benjamin's view that collections lose their meaning when they cease to be personal is challenged by the example of the Warburg Library, which has been transformed from a private collection containing around 15,000 books in 1911 to a public institution today housing over 350,000 volumes, while still maintaining its unique character. Whilst all the world is in pursuit of power, and of wealth as a means of power, culture corrects the theory of success,” writes Emerson in his 1860 essay “Culture.” 1 Perhaps at no point since the publication of Emerson’s essay has the diagnosis it advances been more relevant than today, some 136 years later, when “Culture,” at least in the methodological and political struggles within the academy, has again become the word of ambition. As in Emerson’s nineteenth-century America, those who today pursue that word most ardently also tend—in their struggle to explicate history and culture—to shy away from the persistent instability of meaning with which the texts that they take as their objects of study are vexed. In other words, they are afraid of earthquakes. For Emerson continues: [End Page 200] “There are people who can never understand a trope, or any second or expanded sense given to your word, or any humor; but remain literalists, after hearing the music, and poetry, and rhetoric, and wit, of seventy or eighty years. They are past the help of surgeon or clergy. But even these can understand pitchforks and the cry of fire! and I have noticed in some of this class a marked dislike of earthquakes.” 2It has become one of the methodological orthodoxies of the new contextualism, the increasingly prominent engine driving a continuing metamorphosis of what is perhaps no longer usefully called “Humanities,” to posit a relatively transparent, unproblematic relationship between a textual artifact and its larger cultural or historical context. It is precisely this complex relationship between text and culture—and the theoretical possibility of doing justice to it—that this review of four new publications on Walter Benjamin will revisit.The urgent promise to think through the complicated relationship between text and culture, between the idiomatic artifact and its historical formation, has yet to be fulfilled. How does one account for the singularity of a specific instance of signification, be it a literary text, a film, or a neon sign, articulating the relationship between it and the cultural paradigm that gave rise to it and to which it gave rise? How might one talk about a text’s historicity without forcing a hasty assimilation of it into a crudely mimetic model? One way out of the difficulty, of course, is to suppress the vicissitudes of language altogether, with an eye to hastening the assimilation of a text, seen primarily as illustrative or evidential material, into pre-established assumptions. An example of such a dissatisfactory answer can be found in the introduction to a recent programmatic publication, in which the editors triumphantly proclaim: “Thus, for example, although there is no prohibition against close textual readings in cultural studies, they are also not required.” 3 A marked dislike of earthquakes is at work here. What is more, the logic of such a statement goes as follows: because close reading is no longer necessary, it is dispensable, and therefore eventually no longer performed at all. One is tempted to invoke the famous language of Kafka’s chaplain in The Trial who reprimands Joseph K. for his failure to read closely: “You have not enough respect for writing and you are altering the story.” 4Such methodological difficulties only get worse when one considers the particular problem posed to scholarship by the case of Walter Benjamin, the German-Jewish critic, writer, and philosopher now widely regarded as one of the most significant theorists of our century. Baselitz is one of the most important artists of today. His works can be found in major museums around the world. For over 30 years, photographer Benjamin Katz has been documenting Baselitz at work in different studios. This volume now captures Baselitz's exceptional life at work and at home. Benjamin Katz is famous for his photographic portraits of artists. Among his previous subjects are Gerhard Richter, Joseph Beuys, Sigmar Polke, Rosemarie Trockel, and Martin Kippenberger. But, as he explains in this book, he prefers to photograph people while they are in the process of doing something. Katz shows Baselitz with paintbrush and hammer, and dog and cigar - the close relationship between the two artists is almost palpable. Theories of discourse bring to realism new ideas about how knowledge develops and how representations of reality are influenced. We gain an understanding of the conceptual aspect of social life and the processes by which meaning is produced. This collection reflects the growing interest realist critics have shown towards forms of discourse theory and deconstruction. The diverse range of contributions address such issues as the work of Derrida and deconstruction, discourse theory, Eurocentrism and poststructuralism. What unites all of the contributions (...) is a sense that it is essential to provide a realist alternative to the hitherto dominance of social constructionism, hermeneutics and postmodernism, over many of the issues discussed. By developing a realist perspective the different authors attempt to embed discourse within the structured nature of the reality of the world. Realism can situate language, discourse and ideology within context specific, or 'causally efficacious' circumstances. Realism can help to uncover issues of power, representation, and subjectivity and how discursive and other social practices produce real effects. This can help us understand the manner in which social structures are reproduced through various forms of ideology and discourse. And by knowing this, we can start to address questions concerning human emancipation and how the world is to be transformed. (shrink)
